Predictably, the passage of Proposition 103 in November 2001 encouraged other states to consider laws which also would arbitrarily reduce, rollback, or freeze insurance rates. Moreover, many would follow California by considering bills which would modify or eliminate traditional rating factors.

The asserted rise in insurance rates, rendering insurance unavailable or unaffordable to many, is not a temporary problem; it is a long term, chronic situation which will not be solved by compelling insurers to sell at less than a fair return for a year. Over the long term the state must permit insurers a fair return.
The court left responsibility for implementation of the remaining parts of the initiative and for determination as to what constitutes a fair return to the department of insurance, subject to later judicial interpretation.
